5 Custom Manufacturing & Enamel Pin Liability
CreatePins.com provides custom enamel pin manufacturing services based on customer-submitted designs and specifications.
Design Responsibility Customers are solely responsible for: ensuring artwork accuracy, verifying spelling, dimensions, colors, and specifications, confirming proof approval before production. Once final production proofs are approved, CreatePins.com is not liable for errors in the approved design.
Color & Material Variations Due to the nature of enamel pin manufacturing: slight color variations may occur between digital proofs and final products; minor size, alignment, plating, or finish differences may occur; hand-filled enamel and plating processes may result in minor cosmetic variances. These variations are considered industry-standard and not manufacturing defects.
Tolerances Production tolerances of ±5% in size, color, thickness, or quantity are standard and acceptable.
Third-Party Intellectual Property Customers represent that they own or have permission to use any logos, artwork, trademarks, or copyrighted material submitted. CreatePins.com is not liable for intellectual property violations resulting from customer-submitted designs.
Our liability for defective products is limited solely to: replacement of defective items, OR refund of the original purchase price.
We are not liable for: indirect or consequential damages, lost profits, business interruption, brand or reputational damage.
6 Orders, Payments & Refunds
All custom orders are final once production has begun.
Deposits are non-refundable once design proofs are approved. Refunds or remakes are issued only in cases of verified manufacturing defects.
7 Content Liability
We are not responsible for content appearing on third-party websites that link to us. You agree to defend and indemnify us against claims arising from your website content.
8 Force Majeure
CreatePins.com shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, floods, fires, earthquakes, war, terrorism, civil unrest, government actions, trade restrictions, labor disputes, supply chain disruptions, shipping carrier delays, pandemics or public health emergencies.
Performance obligations shall be suspended for the duration of the force majeure event.
